New Bill Pay Addendum
The New Bill Pay Addendum will go into effect for participants of the new WSECU Bill Pay pilot program on Dec. 13, 2021 and for all NEW bill pay users effective Jan. 10, 2022. The New Bill Pay Addendum will go into effect for all other current WSECU Bill Pay users on the legacy bill pay system who enrolled in bill pay prior to January 10, 2022 on May 9, 2022.
This is an Addendum to the Electronic Funds Transfer Agreement and the Consumer Online Banking Agreement or Business Online Banking Agreement and sets forth the additional terms and conditions for use of the Bill Pay Service offered through Washington State Employees Credit Union (WSECU). By using the Bill Pay Service, you agree to the terms and conditions of this Bill Pay Addendum, the Electronic Funds Transfer Agreement and the Consumer Online Banking Agreement or Business Online Banking Agreement. This Addendum applies to your use of the Bill Pay Service and any portion of the Site through which the Bill Pay Service is offered. The Bill Pay Service enables you to initiate a Bill Payment Instruction from one of your Eligible Transaction Accounts at WSECU, to a U.S. Payee. Bill payments will be initiated on your behalf pursuant to the terms of this Agreement.
Bill Pay Service Definitions.
- Bill Pay Addendum means these Terms and Conditions of the bill payment service.
- Billing Account is the checking account from which all Bill Pay Service fees will be automatically debited. If you have more than one account linked to your Bill Pay Service, fees for the processing of expedited check payments will be assessed against the payment account chosen to fund the bill payment.
- Business Day is every Monday through Friday, excluding Federal Reserve Holidays
- Due Date is the date reflected on your Payee/Biller statement for which the payment is due. It is not the late date or grace period.
- Effective Date is the Send Date.
- Estimated Delivery Date is the day you want your Payee to receive your bill payment. If the date falls on a non-Business Day, it will be considered to be the next business day.
- Payee/Biller is the person or entity to which you wish a bill payment to be directed or is the person or entity from which you receive electronic bills (e-bills), as the case may be.
- Payment Account is the checking account from which you direct bill payments to be debited from. You may have multiple Payment Accounts linked to your Bill Pay Service. It is your responsibility to choose the correct account for payment processing.
- Payment Instruction is the information provided by you to WSECU through the Bill Pay Service for a bill payment to be made to the Payee (such as, but not limited to, Payee name, Payee account number, and Scheduled Payment Date).
- Scheduled Payment is a payment that has been scheduled through the Bill Pay Service but has not begun processing.
- Send Date is the date the electronic item or check is processed. For electronic items, your account will be debited on the Send Date. For those payments to be made by paper check, your account will be debited once the Payee submits the check for payment and the check clears your checking account.
- Service means the bill payment service offered by WSECU through its Service Provider (Payveris, LLC) (“Payveris”).
- Service Provider means companies that we have engaged to render some or all of the Service to you on our behalf.
Online/Mobile Bill Pay Transactions.
Bill Payment Scheduling. For payments sent electronically, payments set up before the designated cut-off time 2:00 p.m. Pacific Time on the Send Date will be delivered in one (1) Business Day after the Send Date.
For payments sent by check, payments set up before the designated cut-off time 2:00 p.m. Pacific Time on the Send Date will be delivered within five (5) Business Days of the Send Date, based on the estimate of average United Stated Postal Service mailing times. For check payments set up for expedited delivery, payments set up before 11:00 a.m. Pacific Time will be sent overnight for next day delivery and an Expedited Bill Pay Charge of $24.95 will be assessed to the payment account you designated for the bill payment.
The earliest possible Estimated Delivery Date for each Payee/Biller made by check payment (typically five (5) or fewer Business Days from the current date) will be designated when you schedule the payment. Therefore, the Service will not permit you to select an Estimated Delivery Date less than the earliest possible Scheduled Payment/Send Date designated for each Payee/Biller.
When scheduling payments, you must select a Send Date that allows the Estimated Delivery Date to be no later than the actual Due Date reflected on your Payee/Biller statement unless the Due Date falls on a non-Business Day. If the actual Due Date falls on a non-Business Day, you must select a Send Date that allows the Estimated Delivery Date to be at least one (1) Business Day before the actual Due Date. Estimated Delivery Date must be prior to any late date or grace period.
Service Guarantee. Electronic Payments will be delivered within two (2) Business Days following the “Send Date”. Due to circumstances beyond the control of the Bill Pay Service, particularly delays in handling and posting payments by Payees/Billers or financial institutions, some transactions may take longer to be credited to your account. WSECU and/or the Service will bear responsibility for any late payment related charges up to $50.00 should a payment post after its Due Date as long as the payment was scheduled in accordance with the guidelines described under "Bill Payment Scheduling" in this Agreement, and scheduled to be received by the Due Date.
Payment Authorization. You represent and warrant that you are acting with full authority to access and use the Bill Pay Service on your payment account(s) or any linked payment account(s) you have been authorized to access through Online Banking.
Sub-users and Global Access. If you have enrolled a sub-user (authorized user) to your online banking and have authorized them to have GLOBAL ACCESS to the Bill Pay Service, you are authorizing them access to initiate payments from all payment shares or accounts enrolled or linked to your Bill Pay Service, even if they have not been set up as a sub-user (authorized user) on each of the linked accounts.
Payment Remittance. By providing the Credit Union with names and account information of Payees/Billers to whom you wish to direct payments, you authorize us to follow the Payment Instructions that we receive through the payment system. In order to process payments more efficiently and effectively, we may edit or alter payment data or data formats in accordance with Payee/Biller directives.
Payment Instruction. When we receive a Payment Instruction, you authorize us to debit your Payment Account on the Send Date and remit funds on your behalf so that the funds arrive as close as reasonably possible to the Estimated Delivery Date designated by you. You also authorize us to credit your Payment Account for payments returned to the Service by the United States Postal Service or Payee/Biller, or payments remitted to you on behalf of another authorized user.
The Credit Union and the Service will use best efforts to make all your payments properly. However, we shall incur no liability and any Service Guarantee shall be void if the Credit Union or the Service is unable to complete any payments initiated by you because of the existence of any one or more of the following circumstances:
- If, through no fault of WSECU, your Payment Account does not contain sufficient available funds to complete the transaction, or the transaction would exceed the credit limit of your overdraft account or the overdraft services plan you have with us;
- The Bill Pay Service is not working properly, and you know or have been advised by the credit union about the malfunction before you execute the transaction;
- You have not provided the Credit Union or the Service with the correct Payment Account information, or the correct name, address, phone number, or account information for the Payee/Biller; and/or,
- Circumstances beyond control of the Credit Union or the Service (such as, but not limited to, fire, flood, or interference from an outside force) prevent the proper execution of the transaction and the Service has taken reasonable precautions to avoid those circumstances.
Provided none of the foregoing exceptions are applicable, if WSECU or the Service causes an incorrect amount of funds to be removed from your Payment Account or causes funds from your designated Payment Account to be directed to a Payee/Biller which does not comply with your Payment Instructions, the Service shall be responsible for returning the improperly transferred funds to your Payment Account, and for directing to the proper Payee/Biller any previously misdirected payment transactions, and, if applicable, for any late payment related charges up to $50.00.
Payment Methods. WSECU or the Service reserves the right to select the method in which to remit funds on your behalf to your Payee/Biller. These payment methods may include, but may not be limited to, an electronic payment, a virtual card payment (a prepaid, single use card), or a check payment.
Payment Cancellation Requests. You may cancel or edit any Scheduled Payment (including recurring payments) by deleting or editing the payment information within the Bill Pay Service application. There is no charge for canceling or editing a Scheduled Payment. Once we have begun processing a payment, it cannot be cancelled or edited; therefore, a stop payment request must be submitted. Any payments which have already been processed before the requested cancellation date will be completed by us. Any Scheduled Payments, including recurring payments, will not be processed once your service is cancelled. We may terminate or suspend your Bill Pay Services at any time. Neither termination nor suspension shall affect your liability or obligations under this Agreement.
Stop Payment Requests. WSECU and/or the Service’s ability to process a stop payment request will depend on the payment method and whether or not a check has cleared. We may also not have a reasonable opportunity to act on any stop payment request after a payment has been processed. If you desire to stop any payment that has already been processed, you must call our Contact Center or visit a branch. Although the WSECU will make every effort to accommodate your request, we will have no liability for failing to do so. We may also require you to present your request in writing within fourteen (14) days. The charge for each stop payment request will be the current charge for such service as set out in the applicable rate and fee schedule.
Failed or Returned Transactions. In using the Bill Pay Service, you are requesting to make payments to your enrolled Payees/Billers from your Payment Account(s), including any linked Payment Account(s) you have initiated access to through Online Banking. If we are unable to complete the transaction for any reason associated with your Payment Account (for example, there are insufficient available funds in your Payment Account to cover the transaction), the transaction may not be completed.
You agree that your use of the Bill Pay Service will be handled in accordance with WSECU’s overdraft procedures or an overdraft services plan you have with us. Refer to our Discretionary Courtesy Pay Policy. A Courtesy Pay Fee or a Non-sufficient Funds Fee will be charged in accordance with WSECU’s Savings Rate and Fee Schedule or Member Business Rate and Fee Schedule, which can be found on our website at wsecu.org.
By enrolling for and using the Bill Pay Service, you agree that WSECU has the right to collect funds from all of your accounts, as well as the available balance on your line of credit account to recover funds for all payments that have been requested to be paid by you and/or your authorized user. This includes accounts on which you are primary owner, as well as accounts on which you are the joint owner. You will reimburse the Service for any fees or costs it incurs in attempting to collect the amount of the returned check from you.
Service Fees and Additional Charges. There may be a charge for additional transactions and other services (i.e., expedited bill pay fee, stop payment fee). You agree to pay such charges and authorize the Service to deduct the calculated amount from your designated Payment Account for these amounts and any additional charges that may be incurred by you. Any fees associated with your deposit accounts will continue to apply. You are responsible for any and all mobile access fees and/or Internet service fees that may be assessed by your data provider.
Limitations on Payments.
Prohibited Payments. Payments to Payees outside of the United States or its territories are prohibited through the Bill Pay Service.
Exception Payments. Tax payments and court-ordered payments may be scheduled; however, such payments are discouraged and must be scheduled at your own risk. In no event shall we be liable for any claims or damages resulting from you scheduling of these types of payments. The Service Guarantee as it applies to any late payment related charges is void when these types of payments are scheduled and/or processed through the Bill Pay Service. We have no obligation to research or resolve any claim resulting from an exception payment. All research and resolution for any misapplied, mis-posted or misdirected payments will be the sole responsibility of you and not of WSECU and/or the Service.
Payee Limitation. WSECU and/or the Service reserves the right to refuse to pay any Payee to whom you may direct a payment. We will notify you promptly if we decide to refuse to pay a Payee designated by you. This notification is not required if you attempt to make a prohibited payment or an exception payment under this Addendum.
Return Payments. You understand that Payees/Billers and/or the United States Postal Service may return payments for various reasons including, but not limited to, Payee’s/Biller’s forwarding address expired; Payee/Biller account number is not valid; Payee/Biller is unable to locate account; or Payee/Biller account is paid in full. The Service will void the payment and credit your Payment Account. You may receive notification from WSECU and/or the Service should this occur.
Information Authorization. Your enrollment may not be fulfilled if we cannot verify your identity or other necessary information. Through your enrollment, you agree that we reserve the right to request a review of your credit rating at our own expense through an authorized bureau. In addition, you agree that we reserve the right to obtain financial information regarding your account from a Payee/Biller (for example, to resolve payment posting problems or for verification).

Electronic Bill (e-Bill) Delivery and Presentment.
This feature is for the presentment of e-Bills only and it is your sole responsibility to contact your Payees directly if you do not receive your statements. In addition, if you elect to activate one of the Bill Pay Service’s e-bill options, you agree to the following:
Information Provided to Payee/Biller. WSECU and/or the Service are unable to update or change your personal information including, but not limited to, name, address, phone numbers and e-mail addresses, with the electronic Payee/Biller. Any changes will need to be made by contacting the Payee/Biller directly. Additionally, it is your responsibility to maintain all user names and passwords for all electronic Payee/Biller sites. You also agree not to use someone else's information to gain unauthorized access to another person's bill. The Service may, at the request of the Payee/Biller, provide the Payee/Biller your email address, service address, or other data specifically requested by the Payee/Biller at the time of activating the e-bill for that Payee/Biller, for purposes of the Payee/Biller informing you about the Service and/or e-bill information.
Activation. Upon activation of the e-Bill feature, the Service may notify the Payee/Biller of your request to receive electronic billing information. The presentment of your first e-Bill may vary from Payee/Biller to Payee/Biller and may take up to sixty (60) days, depending on the billing cycle of each Payee/Biller. Additionally, the ability to receive a paper copy of your statement(s) is at the sole discretion of the Payee/Biller. While your e-Bill feature is being activated, it is your responsibility to keep your accounts current. Each electronic Payee/Biller reserves the right to accept or deny your request to receive e-Bills.
Authorization to Obtain Bill Data. Your activation of the e-Bill feature for a Payee/Biller shall be deemed by us and the Service your authorization for us to obtain bill data from the Payee/Biller on your behalf. For some Payees/Billers, you will be asked to provide us or the Service with your user name and password for that Payee/Biller. By providing us with such information, you authorize us to use the information to obtain your e-Bill data.
Notification. We will use our best efforts to present all of your e-Bills promptly. In addition to notification within the Bill Pay Service, WSECU and/or the Service may send an e-mail notification to the e-mail address listed for your account. It is your sole responsibility to ensure that this information is accurate. In the event you do not receive notification, it is your responsibility to periodically log in to the Bill Pay Service and check on the delivery of the new e-Bills. The time for notification may vary from Payee/Biller to Payee/Biller. You are responsible for ensuring timely payment of all e-Bills.
Cancellation of Electronic Bill (e-Bill) Notification. You understand that an electronic Payee/Biller has the right to cancel the presentment of e-Bills at any time. You may also cancel e-Bill presentment at any time. The timeframe for cancellation of your e-Bill presentment may vary from Payee/Biller to Payee/Biller. It may take up to sixty (60) days, depending on the billing cycle of each Payee/Biller. We and/or the Service will notify your Payee(s)/Biller(s) as to the change in status of your account and it is your sole responsibility to make arrangements for an alternative form of bill delivery. We will not be responsible for presenting any electronic bills that are already in progress at the time of cancellation.
Non-Delivery of e-Bill(s). You agree to hold WSECU and/or the Service harmless should the Payee/Biller fail to deliver your statement(s). You are solely responsible should the Payee/Biller fail to deliver your statement(s). You are solely responsible for ensuring timely payment of all bills. Copies of previously delivered bills must be requested from the Payee directly.
Accuracy and Dispute of e-Bill(s). WSECU and/or the Service are not responsible for the accuracy of your e-Bill(s). We are only responsible for presenting the information we receive from the Payee. Any discrepancies or disputes regarding the accuracy of your e-Bill summary or detail must be addressed with the Payee directly.
These Terms and Conditions of the Bill Pay Addendum do not alter your liability or obligations that currently exists between you and your Payee/Biller.

Any payment(s) the Service has already processed before the requested cancellation date will be completed by the Service. All Scheduled Payments including recurring payments will not be processed once your Bill Pay Service is cancelled. The Service may terminate or suspend service to you at any time. Neither termination nor suspension shall affect your ability or obligations as set forth herein. Termination of the Bill Pay Service may be requested by you, or by any other owner presenting ownership of the account. This Addendum will continue to be in effect for any transactions that cannot be cancelled at the time of your termination.
WSECU reserves the right to terminate or suspend any access to this service immediately should you breach any part of this agreement, the Electronic Funds Transfer Agreement, or of the Consumer or Business Account Agreement or the Consumer or Business Online Banking Agreement. We are also permitted to terminate any or all of the services immediately if we are no longer able to provide such services.
Address or Banking Changes. It is your sole responsibility to ensure that the contact information with WSECU and your user profile is current and accurate. This includes but is not limited to, name, address, phone numbers and email addresses. Changes can be made by contacting the WSECU or making changes through online banking. Any changes to your Payee/Biller information should be made within the Payees section of the Bill Pay Service. All changes are made effective immediately for scheduled and future payments paid from the updated Payee/Biller information. The Service is not responsible for any payment processing errors or fees incurred if you do not provide accurate Payee/Biller information or contact information.
Security Procedure. You, WSECU, and the Service shall comply with the security procedure requirements with respect to Bill Payments transmitted by you to the Service, as well as those required in connection with the Online Banking Services generally. You acknowledge that the purposes of such security procedures are for authentication and not to detect an error in the transmission or content of a payment instruction. No security procedure for the detection of any such error has been agreed upon between the Service, WSECU and you. Your verification of the payment instruction you submit on the Bill Pay Service is your agreement to take full and final responsibility for any and all errors relating to or concerning the payment.
You are strictly responsible to establish and maintain the procedures to safeguard against unauthorized access to your account and transmission of requests for Bill Payments. You warrant that no individual will be allowed to initiate payments on your behalf, in the absence of proper supervision and safeguards and unless specifically added as a sub-user (authorized user) by you. You agree to take all reasonable steps to maintain the confidentiality of the security procedures and all passwords, codes, security devices, and related instructions relating to your account, the Online and Mobile Banking Service and any service provider sites accessed from within Online Banking or user credentials related to electronic Payee/Biller sites for use of the e-Bill service through the Bill Pay Service. If you believe or suspect that any such information or instructions have been known or accessed by unauthorized persons, you agree to notify WSECU immediately. The occurrence of unauthorized access will not affect any Bill Payments made in good faith by WSECU or the Service prior to receipt of such notification plus a reasonable time period thereafter for WSECU or the Service to act on such notice.
Compliance with Security Procedure. If a request for a Bill Payment (or a request for cancellation or amendment of a Bill Payment) received by Service purports to have been transmitted or authorized by you, it will be conclusively deemed effective by the Service, and Service shall initiate the Bill Payment on your behalf and, except as limited by applicable law, you shall be obligated to pay WSECU the amount of such Bill Payment even though the Bill Payment (or request) was not authorized by you, provided Service accepted the Payment Instructions in good faith and acted in compliance with the security procedure referred to in this Agreement with respect to such Payment Instruction. Service shall conclusively be deemed to have complied with that part of such procedure if the password entered in connection with the on-line session associated with the initiation of a request for an Bill Payment matches the password associated with your online account access on the site.
Password and Security. You agree not to give or make available your password or other means to access your account to any unauthorized individual. You are responsible for all payments you authorize using the Service. If you permit other persons to use the Service or your password or other means to access your account, you are responsible for any transactions they authorize. If you believe that your passwords or other means to access your account have been lost or stolen or that someone may attempt to use the Service without your consent or has transferred money without your permission, you must notify the Service at once by contacting WSECU during normal business hours.
Exclusions of Warranties. The Service is provided as is without warranty of any kind, expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
Alterations and Amendments. From time to time, the Credit Union may alter or amend any of the terms and conditions, and applicable fees contained in this Bill Pay Addendum. Such amendments shall become effective as stated on any notice sent to you. Any use of the Bill Pay Service after you are provided a notice of change will constitute your agreement to such changes(s). Further, the Service may, from time to time, revise or update the applications, services, and/or related material, which may render all such prior versions obsolete. Consequently, the Service reserves the right to terminate these Terms and Conditions as to all such prior version of the applications, services, and/or related material and limit access to only the Services’ more recent revisions and updates. In addition, as part of the Service, you agree to receive all legally required notifications via electronic means.
